In my last position (VP HR) I was the one who received the audit notice from the California EDD requesting an appointment and information on our contract workers. An IC who had no other work lined up, filed an unemployment claim and listed us as their employer. We were completely caught off-guard and I was very concerned. We immediately put together a cross-functional team (HR, Purchasing, Legal, Finance), researched the issue to forecast our potential liability. Within 60 days we were in a audit and we only had 35 active ICs on the books. The scary part was they wanted to see prior years data we did not have. More scrambling... In the end, we were lucky as we were able to provide enough info and more importantly demonstrate to the EDD we'd taken proactive steps to properly classify our ICs moving forward. By doing so we were able negotiate the fines and penalties down considerably.

I agree that stepped up worker classification enforcement is in our near future. Companies of all sizes and industries are at risk for audits and will be held accountable even if they unintentionally misclassified.

A lot of companies don't realize that the audit can begin with a questionnaire sent directly to their contractors - asking the IC questions about their relationship status. Most relationships are technically out of compliance and the contractor really has nothing to lose by answering the questions honestly. I'm an IC and I've been sent the questionnaire from the State of California for a client in Ohio. I've also had a visit to my home by the IRS. The government needs the money - be careful out there!
